11. Fees and Taxes
The service fee, currency, taxes, billing period, setup fee and any additional charges shall be shown to the Customer before the order is completed.
Unless expressly stated otherwise, applicable taxes may be added to the prices.
The Turkish lira equivalent of prices denominated in foreign currencies may be calculated using the exchange rate displayed at the time of payment or the rate applied by the payment service provider. The Customer must be able to see the total amount payable before confirming the order.
For pay-as-you-go Services, the fee shall be calculated according to the measurement unit disclosed for the relevant Service and the usage recorded in WE1TOWN’s systems.
12. Payment
The Customer must pay the service fee on the specified date and using the specified payment method.
Payment transactions may be carried out through authorised payment service providers. WE1TOWN may not retain full payment-card information in its systems.

Failure to complete KYC shall not, in every case, result in the forfeiture of the full amount paid. Any refund shall be assessed by considering Service usage, costs already incurred, the nature of the breach and mandatory law.
18. Special Provisions for Proxy Services
This section applies only to proxy and IP services purchased under the WeProxy or WE1TOWN brand.
18.1. Scope of Services
Depending on its product inventory, WeProxy (WE1TOWN) may provide static or rotating, datacenter, residential, ISP, mobile, IPv4, IPv6, shared or dedicated proxy services.
The inclusion of a Service type in this section does not mean that it is always available or in stock. The exact Service characteristics shall be specified in the order summary.
18.2. Proxy Characteristics
The following characteristics of the proxy Service shall be specified on the product page or in the order summary:
-
Number and version of IP addresses;
-
Country or regional location;
-
Traffic allowance;
-
Protocol;
-
Static or rotating structure;
-
Rotation period;
-
Sticky-session duration;
-
Concurrent connection limit;
-
Authentication method.
18.3. IP Allocation
Proxy IP addresses are not sold to the Customer. They are allocated for use during the active Service period.
IP addresses may be changed due to technical necessity, network changes, security incidents, abuse, supplier changes or decisions of competent authorities.
18.4. Location and IP Classification
IP location and connection-type information is based on available technical records and data sources.
Different country, city, ASN or connection-type results shown by third-party databases shall not alone constitute a defective Service. However, where location is an essential element of the order and the IP address is clearly routed through the wrong location, the Customer may submit a support request.
The terms “residential,” “ISP” and “mobile” do not guarantee that a particular third-party platform will classify an IP address in the same manner.
18.5. Third-Party Platforms
WE1TOWN does not guarantee:
-
That the proxy Service will operate on a particular platform;
-
That no CAPTCHA will be displayed;
-
That an IP address will not be blocked;
-
That the Customer’s third-party account will not be closed;
-
That the IP address will not appear on any reputation list;
-
Any particular level of anonymity or non-detectability.
The Customer must comply with the agreements and rules of the third-party platforms used by the Customer.
18.6. Traffic Measurement
For traffic-based Packages, usage shall be measured using WE1TOWN’s network records.
Unused traffic shall not be carried over to the following period unless otherwise stated on the product page.
Failed connections, protocol headers and retransmissions may be included in traffic measurement depending on the technical structure of the Service.
18.7. High Usage
A high number of requests alone shall not constitute abuse. Package limits, the nature of the traffic, its effect on the infrastructure and the quality of service provided to other users shall be assessed together.
19. Special Provisions for Server Services
This section applies only to server and infrastructure services purchased under the WeServer or WE1TOWN brand.
19.1. Scope of Services
Depending on its product inventory, WeServer (WE1TOWN) may provide:

-
Dedicated servers;
-
GPU servers;
-

The exact CPU, RAM, disk, traffic, port, IP, location and virtualisation characteristics shall be specified in the order summary.

-
The operating system;
-
Software;
-
Updates;
-
Firewalls;
-
User accounts;
-
Applications;
-
Licences;
-
Backups;
-
Data security.
19.3. Resource Usage
The Customer must comply with the purchased CPU, RAM, disk, traffic and port limits.
The term “unlimited traffic” or a similar expression does not authorise activities that disrupt the infrastructure, adversely affect other customers or clearly fall outside ordinary use.
19.4. IP Addresses
IP addresses allocated together with a server are not sold. The right of allocation ends when the Service ends.
An IP address may be changed due to network, routing, security, data-centre or competent-authority requirements.
19.5. Operating Systems and Licences
The availability of Linux, Windows or other images depends on product and licence availability.
Third-party software and operating-system licences are subject to their own terms. The Customer is responsible for unlicensed software installed by the Customer.
19.6. Backups
Unless a backup Service is expressly included in the order, WE1TOWN is not obliged to back up the Customer’s data.
The Customer must maintain a current and restorable copy of its data in an environment independent from the WE1TOWN infrastructure.
The provision of a backup Service by WE1TOWN does not eliminate the Customer’s obligation to maintain an independent backup.
19.7. Maintenance and Interruptions
Planned maintenance shall be notified in advance where reasonably possible. Emergency security and infrastructure interventions may be carried out without prior notice.
A specific uptime level or service credit shall apply only where expressly stated in a separately accepted SLA.
20. Special Provisions for Software Services
This section applies only to software, SaaS, licence, API, maintenance and development services purchased under the WeSoftware or WE1TOWN brand.
20.1. Licence
Intellectual property rights in the software are not transferred.

Attempt to obtain the source code;
-
Exceed licence limits;
-
Use the software for unlawful purposes;
-
Exceed API limits or bypass security measures.
20.3. SaaS Services
SaaS Services may require an internet connection and a supported browser or device.
Package features may be restricted by the number of users, storage capacity, number of transactions, API quota and other limits.
The Customer is responsible for ensuring that data uploaded to the system through the Customer’s Account is lawful.
20.4. Updates
WE1TOWN may update the software for security, performance, legal compliance and product-development purposes.
Changes that materially reduce the core functionality of a paid Service shall be notified in advance. Updates required for security may be implemented immediately.
New major versions, additional modules or third-party licences may be subject to additional fees.
20.5. Third-Party Integrations
The software may integrate with third-party APIs, platforms or services.

-
A third party changes its API;
-
A third party restricts access;
-
A third party changes its pricing;
-
A third party terminates its service;
-
A third party restricts the Customer’s account.
WE1TOWN shall use reasonable efforts to provide an adaptation or alternative solution, but does not guarantee the uninterrupted continuation of a third-party service.
20.6. Custom Software Development
The following matters shall be set out in a separate written quotation or project document for custom development Services:
The Customer must inspect the deliverable and provide acceptance or a specific defect notice within [7/14] days. Mandatory consumer provisions remain reserved.
Out-of-scope requests may be subject to additional time and fees.
20.7. Customer Data
Ownership of data uploaded by the Customer to the software remains with the Customer or the relevant rights holder.
WE1TOWN shall process such data only to the extent necessary to provide the Service, maintain security and comply with legal obligations.
21. Service Support
The scope of standard support shall be described on the relevant product page or in the order summary.
Support may be limited to:
-
Infrastructure and Service access;
-
Account and payment issues;
-
Licence activation;
-
Technical errors attributable to WE1TOWN.
The Customer’s custom software, code, server configuration, third-party systems or custom integrations are not included in standard support unless separately purchased.
Support periods are estimates unless separately guaranteed under an SLA.
22. Service Level
A specific uptime, response time, resolution time or service credit shall apply only where a service-specific SLA exists.
Unless otherwise stated in the SLA, the following may be excluded from availability calculations:

WE1TOWN does not acquire ownership of Customer Content.
The Customer grants WE1TOWN only the limited processing authority required to provide, back up, secure and technically operate the Service.
24. Notices of Unlawful Activity
Alleged unlawful activity or infringement carried out through the Services may be reported through [abuse email address].
Where possible, the notice should contain:
-
The relevant URL, IP address or Service;
-
The date and time of the incident;
-
A description of the infringement;
-
Technical records or evidence;
-
The complainant’s contact information;
-
An explanation of ownership where infringement of rights is alleged.
WE1TOWN shall assess valid notices and decisions of competent authorities in accordance with applicable law.

-
A serious or repeated breach of the Agreement;
-
An attack, fraud or abuse;
-
An imminent and serious security risk;

-
Failure to complete the KYC process;
-
A request or decision from a competent authority;
-
The need to protect the infrastructure or other customers.
Except in emergencies, the Customer shall be granted a reasonable period to remedy the breach.
Any measure taken shall, where reasonably possible, be proportionate to the severity of the breach.
26. Termination of the Service and Data
Before the Service ends, the Customer must export its data, files, licence information and required records.
After termination of the Service, Customer data may be retained:
-
For [15/30] days following normal termination;

As a general rule, a Consumer may withdraw from a distance service contract within fourteen days from the date on which the contract is formed, without providing a reason and without paying a penalty.
However, where the Consumer:
-
Expressly requests that the Service begin before the withdrawal period expires;
-
Is informed in advance of the consequences of that request;
-
Provides the required separate confirmation,
the applicable legal provisions governing Services commenced before the expiry of the withdrawal period shall apply.
The statutory exception to the right of withdrawal may apply to Services performed immediately in an electronic environment and intangible goods delivered immediately to the Consumer.
The application of the exception shall be assessed by considering the nature of the Service or Digital Content, the delivery method, completion of performance and the confirmations obtained.
The Consumer’s statutory rights arising from defective goods or defective Services remain reserved.
29. Cancellation and Refunds
Refund requests shall be assessed according to the following principles:
-
